It depends whether it meets Australian/New Zealand Standard 4280.1. My guess is that it doesn't.
This standard require the EPIRB to operate for a minimum of 48 hours and float upright when deployed in water.
Whilst SPOT states that its unit is waterproof, it doesn't state that it meets the Aus/NZ standard. This may be because it is produced in the USA.
However, from a 4WDing point of view, I have found it a great tool to keep family & friends in touch with our travels. Hopefully the 4WD doesn't end up in the water and I have to test it out!

From a regulatory point of view, ie sailing rules, etc, NO.
